TERMS OF ONLINE SALE


The customer should always read the terms and conditions online before placing an order on the site. He will be asked to expressly agree to these terms in each order, otherwise the transaction can not be completed

2.GENERALITES


Only these conditions of sale apply for ONLINE SALE between the seller and its customers.


They apply to the exclusion of all other conditions, even those listed on purchase order from the buyer. The seller reserves the right to modify at any time these terms and conditions. However, current contracts remain subject to the conditions applicable at the time the sale is concluded.


The agreement may be made in English, French or Dutch, the customer's choice. The exchange of information will also be higher in one of these languages. The client can not rely on his lack of knowledge of the language to invoke the non-application of one or more conditions.


3.CONCLUSION of the ONLINE SALE


The product catalog and online description does not constitute an offer as such. There are therefore sufficient to go through the ordering process on our site for the formation of the contract of sale. The sale will be concluded definitively that upon receipt of the order confirmation email.


For security reasons, the seller reserves the right to request additional information to customers and to refuse enforcement of the order in the absence of adequate response.


4.TRANSFERT OF PROPERTY


Notwithstanding Article 1583 of the Civil Code, the seller retains ownership of the goods until full payment. However, the burden of risk of loss and damage relating to the goods concerned is transferred to the customer upon taking possession.


5.PRIX


Our prices include VAT. Normal delivery fees and shipping are based on the shipping address of the customer. Renting a truck is not within the scope of normal costs (see below).


The products offered for sale are subject to change. When ordering, the price displayed at the time of order which will apply to this ONLINE SALE.


6.Payment

7.DELIVERY AND INSTALLATION


For client safety, the driver may ask the client credentials (or a copy) at delivery. The customer sign for receipt of the delivery.


When the place of delivery is located in a not very accessible place and in all cases for all delivery points located beyond the third floor of a building without elevator of sufficient size, the customer must provide an adequate capacity lift. Seller may, at the request of the customer, provide a standard truck for deliveries to the sixth floor against the payment of a fee.


If delivery can not be made due to the absence of the customer or due to his refusal to take delivery of the goods at the agreed time with the seller, the customer must pay additional fees.

In case of complaint, the buyer should also contact the Office of the carrier of Great Story(SàRL).


Under penalty of inadmissibility of the application, the buyer will:


· Wear on the delivery specific reserves and motivated in case of damage or missing, the general reservations of the kind "subject to unpacking" is insufficient.


· Confirm reserves for missing or damage and make its other reserves, by registered letter with acknowledgment of receipt to the seller headquarters.

8.2 Notes on delivery


The buyer must proceed upon delivery, all examinations necessary to detect any damage, shortages, defects or other defects or non-compliance of the Products delivered with the order. Buyer must verify the status of packages, the number of packages and products in their amounts, their references, their state and their characteristics.


Complaints for defects or visible damage on the goods delivered and all claims relating to damage caused by our drivers should be a special mention on the delivery notes. This also applies to incorrect or incomplete deliveries.


In case of complaint, the buyer should also contact the Office of the carrier of Great Story(SàRL).

9.Warranty


Old furniture or antiques is obviously non-subject to any warranty.


The legal warranty of 2 years is in application for the new furniture.


a) This warranty covers only defects existing compliance at the time of delivery of goods. Are therefore excluded:


- Any direct or indirect damage to the unit after delivery (eg by oxidation, shocks, falls, ...);


- The replacement of parts or accessories whose regular renewal is necessary (eg batteries, bags, lamps, rubber spare parts ... (not limited list);


- Damage due to fire, water damage, lightning, accident, natural disaster;


- Defects caused by negligence or explicitly, by injudicious treatment, improper maintenance or improper or not in accordance with the manufacturer's use;


- Damage due to a commercial, professional or collective use.


b) The non-compliance must be reported within two months after its discovery.


c) Any request must be directed to our after-sales service. When the client requests directly to the manufacturer under warranty, any costs incurred shall be borne. In case of intervention by a third party who is not designated by the seller the benefit of the guarantee is canceled. The possible return of a purchased item is charged to the client.


10.WITHDRAWAL RIGHT

The customer has the right to withdraw the purchase without penalty and without giving any reason at the time the delivery is not provided within 30 days.


Pursuant to the Act of 6 April 2010, the consumer has the right to notify the seller that he renounces the purchase without penalty and without giving any reason, within 14 days from the day after delivery of the product . The furniture damaged or incomplete will not be taken back.


The customer who wishes to exercise this right must contact seller within 14 days by mail to office@barak7.com


Excluding any costs specific to the delivery and return that are always left to the charge of the buyer, the seller agrees to refund the customer within 30 days of the acceptance of the return of the goods ordered.


11.PROOF


The parties accept electronic evidence (email, backup, ...).


12. LAW AND JURISDICTION


Any dispute will be subject to Luxembourgian law.


In case of dispute between the parties concerning the validity, interpretation or execution of this Agreement, which can not be amicably resolved, the parties will attempt to resolve the dispute by mediation in accordance with Regulation Mediation.


Mediation will commence no later than 15 days after the request for mediation notified by one party to the other party and the duration of mediation shall not exceed 15 days, unless expressly agreed by the parties.


If mediation fails, the parties shall submit the dispute to arbitration, another member bMediation who conduct to a Med-Arb.
